Postie General Terms and Conditions of Use

Definitions

"Alturing": mean Alturing SAS, with corporate capital of EUR 37,000, registered in the Commercial Register of Paris under number 403 340 029 and whose registered office is located at 3, Boulevard Romain Rolland, 75014 Paris, France, the company operating the Website on behalf of La Poste.

"Customer": subsidiaries of La Poste having obtained access codes to the Postie application in order to extract data relating to their own business customers (contract between the subsidiary and its customer, the customer’s consumption, the customer’s rates, etc., such data excluding any personal data except for the subsidiaries’ business contacts).

"Colt Technology Services": the company hosting the Website, a simplified joint-stock company (SAS) with capital of EUR 129,692,064, registered in the Commercial Register of Nanterre under number B 402 628 838, located at 23-27 rue Pierre Valette, 92240 Malakoff, France.

"La Poste": means La Poste SA, a company with corporate capital of EUR 5,620,325,816, registered in the Commercial Register of Paris under number 356,000,000 and whose registered office is at 9 rue du Colonel Pierre Avia, 75015 Paris, France, acting through its International Business Unit, (CP Y805) 9 Rue du Colonel Pierre 75015 Paris, France.

"La Poste Operators": means La Poste employees and partners (including Customers) responsible for entering the various data items relating to the Customer’s traffic or billing or permitted to carry out data extraction operations on data relating to them or to their business. Each La Poste Operator has access to the Website restricted to their field of competence.

"Postie": whose domain name is www.laposte.fr/postie, (hereinafter the "Website") is a secure website that allows tracking of the various stages of the services provided to the Customer, from ordering to billing.

"User": an employee of La Poste or of its subsidiaries acting in relation to the formation of contracts with La Poste, billing data and sales administration

"Processing": processing containing identifiable personal data communicated through the Website as part of performance of the services.


1. Purpose of the Website

The Website aims to allow tracking of certain services provided to Customers, from ordering to billing, with the following options available:

- Entry of the name of the La Poste offer contracted by the Customer (details of the Customer’s La Poste contract and rates) and their customer sub-accounts.

- Entry of the Customer’s traffic and Customer’s sub-accounts by Operators of La Poste

- Entry of the Customer’s billing data by Operators of La Poste

- Transfer of data to perform certain services (sales administration, billing). These transfers may be made to countries outside the European Union depending on the location of the sender or the recipient of a despatch. These transfers are essential for performance of the contract.

- Billing of the Customer

- Ability of the Customer to view data relating to their consumption, traffic and invoices.

- Sending alerts to the Customer’s messaging service

- Billing tracking

The purpose of the processing performed by La Poste via Postie is the fulfilment of a contract which includes use of the Postie Website and collection and processing of the billing data of Customers of La Poste’s import and export international services.


2. Scope of the General Terms and Conditions of Use

This document contains the General Terms and Conditions of Use of the Website. Its purpose is to set out the terms and conditions of use of the Website by the User. La Poste reserves the right to change the Terms and Conditions of Use without notice.


3. Access conditions to the Website’s pages

3.1: Accessibility.

The Website is accessible for viewing 24 hours a day subject to update or maintenance interruptions or in the event of malfunctions resulting in particular from telecommunication operators. Access to and management of the Website are provided by La Poste.

The Customer and Operators of La Poste have access to the Website via a personal login and password.

The Customer has access only to its own data.

La Poste Operators have access to the Website, restricted to their fields of competence.

3.2: Account creation

Access to the account involves creating a login account and having a user name (hereinafter "Login") and a password. It is recommended that the User regularly changes their password, at least once every 90 days.

Account creation data is personal and confidential. The User undertakes not to disclose it to a third party, to inform La Poste of any unauthorised use by a third party and of any security breach which could result from it. The User undertakes to immediately inform La Poste of any unauthorised use of their account and/or password and/or any security breach. The User must ensure that at the end of each session, they disconnect in a secure way.

To access their account, the User must use a recent browser that complies with international standards.

3.3: Deletion of the User account

Use of the Website is subject to signature of a contract with La Poste.

La Poste undertakes to maintain the User account active throughout the lifetime of the contract that it has with the Customer. It is the Customer’s responsibility to save the data relating to its contract contained on the Website, with no undertaking of La Poste as regards data retention or duration of the contract. La Poste may continue to use the Website data to meet its statutory obligations.

The Customer may only cancel its account and be deleted from the User database on the expiry date of its contract with La Poste. To delete its data, the Customer must make a request to do so to its usual sales contact.

3.4: Data retention period

The Customer is informed that as an exception to the provisions of Article 3.3 above, certain data items, such as the invoices issued in the Customer’s name will be archived by La Poste and retained for the mandatory statutory period. The data retention period is described in the Postie Privacy Policy accessible here


4. Files

The following file types can be uploaded:

- automation service (examples: .doc, .xls, .txt, .csv, .rtf, .ppt),

- compressed (examples: .rar, .zip)

- image (examples: .gif, .jpg, .png, .psd, .raw).

Executable files (examples: .exe, .bat) are excluded and cannot be uploaded.

The size of a file cannot be greater than 100 MB.


5. Liability of La Poste relating to use of the Website

La Poste undertakes to take all useful precautions to ensure the security, confidentiality and integrity of the Personal Data it processes, in order to prevent it being distorted, damaged or communicated to non-authorised persons. As such, it undertakes to put in place technical and organisational measures to ensure an appropriate level of security and confidentiality with regard to the risks involved in processing and to the nature of the processed Personal Data.

As Data controller, La Poste undertakes to communicate, as quickly as possible, all information allowing the Customer, the User and the Operators of La Poste, insofar as it concerns them, to meet the request of a person whose Personal Data is processed, a request which may relate in particular to the right of access, rectification, objection for legitimate reasons, erasure or portability of the processed Personal Data.

La Poste may not be held liable in any regard, for any direct or indirect harm or for any loss or injury of any kind suffered by the User or the Customer due to: (i) temporary unavailability of the Website, (ii) all suspensions or interruptions of the service for any reason including malfunction or suspension for maintenance reasons, (iii) the acquisition or use of the Password by unauthorised persons.

La Poste shall not be held liable with regard to information that could be displayed on the Website due to a malevolent act perpetrated by a third party on the information system and disclaims any liability with regard to disruptions, technical incidents, viruses and other problems that could result from the use of electronics and telecommunications.

In the event of force majeure, La Poste disclaims any liability. Apart from cases normally accepted by case-law and precedents, the following shall be deemed force majeure events: the non-performance, delay or imperfect performance of any of La Poste’s obligations resulting from a total or partial strike, internal or external to one or other of the parties, negatively affecting the said party’s activity, war, riot, insurrection, storms, floods, the blocking of means of transport and telecommunication and, more generally, any event independent of the will of the party suffering from this unforeseeable or force majeure event.

Connecting to the Website implies knowledge and acceptance of the characteristics and limits of the Internet, in particular as regards technical performance, the risks inherent in any connection to and transmission over the Internet, the lack of protection of certain data items against possible hijacking or hacking and the risks of infection by any viruses present on the network. Therefore, without this list being exhaustive, La Poste may in no circumstances be held liable for the following:

- the transfer and/or receipt of any data item and/or information on the Internet, or telephone connection problems,

- any malfunction of the Internet preventing operation of the Website in whole or in part,

- the malfunction of any receiving equipment or communication lines,

- delivery problems and/or the loss of any email and, more generally, the loss of any data item,

- the functioning of any software, the consequences of any virus, computer bug, breakdown, technical malfunction, errors of human or electric origin,

- any technical hardware or software malfunction of any kind having prevented or limited the possibilities of viewing the Website or having damaged a User’s system.

It is hereby specified that La Poste may not be held liable for any direct or indirect damage resulting from an interruption or malfunction of any kind or any direct or indirect damage caused to a User’s computer equipment and to the data stored on it, that could result, in any way, from connecting to the Website, or the consequences resulting therefrom on this User’s personal, professional or commercial activity.

It is the responsibility of each User to take all appropriate measures to protect its own data and/or software stored on its computer equipment against any damage. Any connection to the Website is made under the User’s entire responsibility.



6. Right of ownership

Use of the Website does not grant any right of ownership to the data made available by La Poste. Users and Customers use the Website for their own account.

Consequently, Customers and Users undertake to use the data, information and responses obtained through the Website for their sole internal needs, not to disclose them to third parties, either free of charge or for a fee and not to market or sell them directly or indirectly. Non-compliance with this condition shall result in deletion of the User’s account and login, without prejudice to any action claiming damages that La Poste could bring against the offender.

The data exchanged is subject to the contractual provisions set out in the contracts entered into between La Poste and the Customer.



7. Assistance

Any information about the Website or use of the Website’s services can be obtained from your usual sales contact.


8. Maintenance

La Poste reserves the right to interrupt all or part of the services and content of the Website for maintenance reasons or for any other reason without this interruption giving an entitlement to compensation of any kind.

Customers have a right to access and correct all their personal data

10. Complaints

Any complaint relating to use of the Website must be made in writing within one (1) month, by recorded delivery letter with acknowledgement of receipt, sent to the following address:

If the Customer does not receive a satisfactory response to their request, they can contact the DPO of Groupe La Poste at the following address:

If the Customer experiences problems relating to the management of their personal data, they can lodge a complaint with the French data protection authority, the Commission Nationale Informatique et Libertés, at the following address:

11. Applicable law - Competent courts.

These General Terms and Conditions of Use are governed by French law; in the event of a dispute between a User and La Poste on the interpretation, performance and fulfilment of any of the provisions herein and if a mutual agreement is not reached, the Courts of Paris have exclusive competence to hear the dispute.
